may sound silly...
but can E1 be split, not to be used by both Nod and GDI
but rather that one side uses E1 and another something else instead E1

atleast by some hex edit of game.exe ?

simply set owner= and prerequisite= of [E1] to GDI/NOD and GAPILE/NAHAND ONLY, then make other infantry rules

but, you will have to edit the AI to use the new infantry that you have set up in place of the E1.

It's pretty common practise. It also means that E1 can be changed from 'Light Infantry' to 'Droppod Marine' without having to go fiddling with the exe.

these both are E1
but how can I/you know which one GDI uses and which one Nod ?

as it seems both sides uses both (for apc scenarios and alike)

Make a copy of [07E04DC0-G] and [08602640-G] say they are now [07E04DC0-N] and [08602640-N] plus give them both a Nod Inf. (Also add both to the
[TaskForces])

Now search the AI and AI FS for 07E04DC0-G.

07E04DC0-G will come up as a TaskForce a few times. The good news is that they are named. It will tell you if this TeamTypes is for Nod or GDI under the name.

Now change TaskForce=07E04DC0-G to TaskForce=07E04DC0-N on all Nod TeamTypes and your done.
