Say I was going to put out a professional album and get it on spotify and what not and it was going to sample a song from the old mod blitzkrieg. not complete steal it but use key parts from it. On this forums that would be against the rules for mods but would if it was a professional album? Legally I read it's legal however the original owner has the say over his percent he gets out of it and he can set it up so he takes the stream for nearly ever penny earned. so if I where to sample Blitzkriegs Das boot theme remix What would I have to pay or credit or is there stuff I don't know about saying I cannot do this? Can I do this?

Now I'm interested in the source.

If this is legal then what's stopping me from making  and selling my own album created from samples from all over?

Other artists have done this Tak02. lots of 90s rappers sampled from the 80's and 70's and they're doing it again. like I said there may be more to it that's what I'm trying to figure out.

Legal rights to use the music in your music. Samples are cleared for use by their copyright holders nowadays, with the exception of some music that falls within a previously exempt time limit set by the new music industry laws.

I think I looked more into it. there's a difference between reusing or sampling just one instrument as opposed to an entire loop or part of the song. I may be able to get away with sampling a part of that das boot remix that uses the original das boot but if they wanted they could take legal action to easy so it's highly not recommend nor worth the risk of getting taken for every penny made from it. It's hard to tell for sure but odds are they'd just make you pay a fine and take the song of your listing. but like I said one instrumental versus and entire looped part.

You have to negotiate with the original song author, this isn't so much a question of legality but rotalties.

I cant remember who made the music in Blitzkrieg but the mod has been dead for over a decade & most of the people that worked on it have left the community long ago. So it might not be possible to track down & ask the song's author.
